ORDER 1. Heard. 2. The petitioner has filed this petition against the judgment dated 19.1.2010, passed by the M.P. State Cooperative Tribunal, Bhopal. However, learned counsel for the petitioner has submitted that the petitioner has not been paid retiral dues after his retirement and the petitioner has also not been paid suspension allowance during the period of suspension. 3. By the impugned order the Tribunal has upheld the order passed by the Joint Registrar, Cooperative Societies in regard to quashment of termination order of the petitioner but the Tribunal further ordered that the petitioner shall be eligible to receive 50% back wages from the date of his termination upto the date of his attaining the age of susperannuation. When the order of termination has been quashed, certainly the petitioner shall be entitled all the retiral benefits counting his continuous service upto the age of superannuation. It is also obligatory on the part of the respondent No. 1-Bank to regularize the suspension period of the petitioner in accordance with the rule and pay the allowance also. 4. In the view of the matter this petition is disposed of with a direction that the petitioner shall be paid retiral benefits within a period of eight weeks from the date of receipt of the copy of the order and his suspension period be also regularized in accordance with law and he shall also be paid the suspension allowance, if it has not been paid. No order as to costs.
