Judgment :- 1. Heard the learned counsel for the petitioner, as well as the learned Additional Government Pleader appearing on behalf of the respondents. 2. The main contention of the learned counsel for the petitioner is that the second respondent had passed the impugned order, dated 03.03.2011, without giving an opportunity of hearing to the petitioner. 3. The learned Additional Government Pleader appearing on behalf of the respondents had submitted, on instructions, that no notice had been issued to the petitioner, before the impugned order, dated 03.03.2011, had been passed by the second respondent. 4. In such circumstances, the impugned order, dated 03.03.2011 is set aside. However, it is made clear that it would be open to the petitioner, to pass appropriate orders, as he deems it fit to do so, in accordance with the relevant provisions of the Tamil Nadu Panchayats Act, 1994, after giving an opportunity of hearing to the petitioner. This Writ Petition is ordered accordingly. No costs. Consequently, connected Miscellaneous Petition is closed.
