JUDGMENT Rajiv Sharma, J. Petitioner was appointed as daily wage mason on st January, 1987. He has worked continuously with the respondent-department for more than ten years and has completed 240/180 days in non-tribal/tribal areas in each calendar year. However, he has been conferred with the work-charged status vide Annexure A-1 on 20th January, 2003. The case of the petitioner, in a nutshell, is that since he has been engaged before 31.12.1993, as per law laid down in Mool Raj Upadhyaya versus State of Himachal Pradesh and others, 1994 Supp. (2) SCC 316, his case was required to be considered immediately after completion of 10 years’ service for conferment of work-charged status w.e.f. 1.1.1997. Respondent-State has not chosen to file any reply till date. 2. Consequently, the petition is disposed of with a direction to the respondents to consider the case of the petitioner in view of Mool Raj Upadhyaya’s case (supra) for conferment of work-charged status immediately after completion of 10 years, i.e. with effect from 1.1.1997, with all consequential benefits, within a period of two months after the production of certified copy of this judgment. The pending application(s), if any, also stands disposed of. No costs.
