JUDGMENT Rajiv Sharma, Judge Petitioner filed an Original Application No. 04 of 2003 before the erstwhile Himachal Pradesh Administrative Tribunal for the redressal of his grievance. The same was directed to be treated as a representation to respondent No. 3, i.e., Director of Education, Himachal Pradesh. The Director of Education has passed the office order rejecting the case of the petitioner on 7th February, 2003. A bare perusal of the office order reveals that the same is neither speaking nor detailed. Once the learned Tribunal has directed the Original Application itself to be treated as a representation, the same should have been decided by passing a speaking/detailed order, after taking into consideration all the grounds/pleas raised therein. 2. Consequently, the petition is allowed. Annexure P-6, dated 7th February, 2003 is quashed and set aside. Since the dispute pertains to the grant of pay scale as per Annexure P-1, the Secretary Education, Government of Himachal Pradesh is directed to decide the Original Application/representation afresh by passing a speaking/detailed order, after taking into consideration all the grounds/pleas raised therein, within a period of two months from the date of production of certified copy of this judgment by the petitioner. No costs.
