JUDGMENT 1. - Heard learned counsel for the parties. 2. The petitioner has challenged the order dated 22.2.2010 passed by the learned A.C.J.M. Deedwana, whereby the learned Magistrate has directed reinvestigation of the matter to be conducted and that too in a particular way by a particular officer. 3. Counsel for the petitioner has placed reliance on the judgments of the Hon'ble Apex Court in the case of Ramchandran v. R. Udai Kumar, AIR 2008 SC 3102 , and Meetha Bai Pasa Bai Patel and Ors. v. State of Gujarat, AIR 2009 (Suppl.) SC 1658 , and has submitted that re-investigation and that too in a particular way cannot be directed to be done. He has also submitted that the learned Magistrate has no jurisdiction to direct that the investigation of the matter should be done by a particular officer. 4. On perusal of the impugned orders and the earlier orders passed by the learned Magistrate, it is observed that the police has submitted Final Report in the matter on three occasions and twice re-investigation has been directed. By the impugned order, the learned Magistrate has directed the police reinvestigation the matter and further a direction has been given that the reinvestigation should be done by an officer of the rank of the Additional S.P. A direction cannot be issued by the lower Courts to which officer has to investigate the matter. This is absolutely the domain of the investigating agency and the learned Magistrate does not have the jurisdiction to direct the investigation to done by a particular officer. If at all, report submitted by the investigating agency discloses the cognizable offence, then the Magistrate is at liberty to pass an order in accordance with Section 190(1)(b) Criminal Procedure Code but the direction to re-investigate the matter and that too by a particular officer could not have been given. 5. In this view of the matter, this petition is allowed. The impugned order is quashed and set aside. The learned Magistrate is directed to pass appropriate orders on the Final Report submitted to it in accordance with law.Petition allowed. *******
