Sheo Kumar Singh and Rajesh Chandra, JJ. Argument is that in respect to managerial issue and the action taken from the side of the petitioner against certain teaching staff, earlier several writ petitions came up before this Court and some of the writ petitions as noted have been decided by order dated 21.6.2011. 2. The writ petition no.33905 of 2011 is still pending. 3. Submission is that in view of complicated issues on merits in respect to the impugned action taken by the petitioner being pending in this Court, lodging of the report cannot be otherwise justified and in any view of the matter after getting the record of writ petitions i.e. writ petition no.33905 of 2011 and other writ petitions as noted in the order of this Court in the writ petition referred above an opinion on the merits may be formed. 4. In support of the submissions for not taking any action, decision given by the full Bench in Ajit Singh @ Muraha v. State of u.P. and others (2006 (56)ACC 433) which reiterates the view taken by the earlier Full Bench in Satya Pal V. State of u.P. and others (2000 Cr. L. J. 569) was referred. 5. Be as it may, it will be appropriate that all the petitions be placed on the date fixed and in the meantime, learned AGA may also obtain instructions in respect to the complete facts and the report of the Government on the basis of which, the FIR has been lodged. 6. Liberty is given to Ramjan Ali to move appropriate application for impleadment in this petition and also to bring the relevant records so as to assist this Court in the matter. 7. Let the case be posted as fresh case on 12.7.2011 before appropriate Court. 8. Till the next date of listing the arrest of the petitioner who is involved in case crime no. 1149 of 2011, under Sections 419, 420, 467, 468, 471 IPC, Police Station Kothibhar, district Maharajganj shall remain stayed subject to the restraint that petitioner shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation.
