Judgment :- 1. Heard the learned counsel for the petitioner and Mrs.Dhakshayini Reddy, learned Government Advocate, who takes notice on behalf of the respondents. 2. The issue involved in this case has already been decided by the Hon'ble First Bench of this Court in W.P.No.31639 of 2007 dated 15.04.2008 (R.Sumathi vs. The Director of Teacher Education, Research and Training (DTERT), College Road, Chennai 6 and others), wherein by considering the fact that the petitioner therein was only marginally over aged by six months, direction was issued to the respondents by allowing the writ petition, to permit the petitioner to appear for the first and second year practical examinations as well as the second year theory examinations to be conducted by the respondents. 3. On the facts of the present case, it is stated by the learned counsel for the petitioner that one student by name K.R.Sarulatha, who has completed her +2 examinations and subsequently completed her B.Com., degree, has joined the petitioner Institution to undergo the 2 year D.T.Ed., course for the academic year 2010-11 in 31.07.2010 and she was admitted on the said date under the Management Category. When the name of the said candidate was sent by the petitioner Institution for approval, the third respondent, the Principal, District Institute of Education & Training, Kumulur, Trichy, has informed that her name could not be approved for the reason that she was over-aged by 4 months and 14 days. 4. Considering the above said facts and circumstances of the case, as the student belongs to Backward Class community and complying with the prescribed qualifications as well as ailing from a rural family, since the over-age is less than six months, viz., in this case, 4 months and 14 days, I am of the considered view that the said candidate, viz., K.R.Sarulatha, must be permitted to undergo the D.T.Ed., course for the academic year 2010-11 from the petitioner Institution from 30.07.2010 onwards. 5. Accordingly, the writ petition stands allowed, directing the respondents to approve the admission of the student by name K.R.Sarulatha, of the petitioner Institution to undergo her first year D.T.Ed., course for the academic year 2010-11 from 30.07.2010, including that the said student should be permitted to write all the examinations through out the period of the course. No costs. Connected miscellaneous petition is closed.
