JUDGMENT Deepak Gupta, J. This petition is totally misconceived. The order which is under challenge in this appeal is an order of the First Appellate Court remanding the case to the trial Court. Since an appeal would lie against the impugned order in terms of Order 43 Rule 1 (u) CPC, therefore, the petition is rejected with liberty reserved to the petitioner to file appropriate proceedings.
