JUDGMENT Kurian Joseph, C.J. The writ petition is filed challenging Annexures P-3 and P-5, orders passed by the Assistant Commissioner and Divisional Commissioner, respectively. On 7th March, 2011 we permitted the petitioner to pursue his remedies before the Assistant Collector, where he was proceeded exparte. We are informed that the petitioner has already filed an application. 2. In the above circumstances, this writ petition is disposed of directing the Assistant Commissioner to consider and dispose of the application filed by the petitioner seeking to set aside the exparte order within a period of three months from the date of production of a copy of this judgment by the petitioner before the third respondent. An opportunity of hearing shall be afforded to the petitioner and respondents No. 1 and 2. The petitioner will also serve a copy of this judgment and a copy of the writ petition on the second respondent as well. We make it clear that we have not adverted to the merits of the contentions taken by the parties nor to their available defences. Those are all left open. 3. The writ petition is disposed of, so also the pending applications, if any.
