JUDGMENT Kurian Joseph, J. The petitioner claims that she has been engaged by the PTA in the year 2005 and continued so till 2008 in Government Senior Secondary School, Rally Jagri. But according to the petitioner when regularly recruited teacher was appointed, she was dis-engaged. It is the submission of the petitioner that in case regularly recruited teacher Shri Dinesh Kumar is accommodated in the nearby School at Barthin, the petitioner can continue as Lecturer (Hindi) on PTA basis till she is otherwise replaced by a regular recruitee. The Principal of the Government Senior Secondary School, Rally Jagri is present before us. It is submitted that the petitioner was engaged by the local PTA not in terms of any PTA policy and that she was not paid out of the PTA grant-in-aid Scheme. Therefore, even if Shri Dinesh Kumar is adjusted in the nearby School, unless the local PTA engages the petitioner, the Principal cannot appoint the petitioner under the PTA policy since she is not otherwise recruited as per the policy. In the above circumstances, this writ petition is disposed of as follows: 2. In the event of Shri Dinesh Kumar, Lecturer (Hindi) is accommodated in GSSS, Barthin as per the willingness of Shri Dinesh Kumar for his transfer to GSSS, Barthin against the resultant vacancy, it will be open to the PTA Committee of the GSSS, Rally Jagri to appoint the petitioner. We make it clear that in case any selection is made as per the new PTA policy, the petitioner shall also be permitted to participate in the selection process. 3. The writ petition is disposed of, so also the pending applications, if any.
