Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the first respondent to dispose of the claim petition of the petitioner dated 30.12.2010 and 19.1.2011 to enhance the compensation awarded to the petitioner vide the proceedings of the third respondent dated 31.8.2009 in Spl.DRO.286/2009 (NH-68) for acquisition of land of the petitioner situate in Survey Nos.824/2A1, 824/3A1 and 831/2 of Chinna Salem (North), Kallakurichi Taluk within an appropriate time. 2. Mr.S.Shivashanmugam, learned Government Advocate, takes notice on behalf of the respondents. By consent of both parties, the writ petition is taken up for final disposal. 3. Petitioner's lands were acquired under the National Highway Act, 1956. By order dated 22.12.2010 in W.P.No.28944 of 2010, the District Collector, Salem was directed to consider the claim for enhancement of compensation in terms of the National Highways Act. It now appears that the District Collector, Salem by his letter/ proceedings X/K/5285/2011/gp 2 dated 8.2.2011 transmitted all the files to the District Collector, Villupuram and also passed another letter/proceedings e/f/8328/2011/gp 2 dated 2.3.2011 calling upon the Special District Revenue Officer (LA), Salem to take appropriate steps to transmit the name of the District Collector, Villupuram instead of District Collector, Salem. 4. In view of the above stated proceedings, the District Collector, Villupuram, the first respondent is directed to consider the claim of the petitioner for enhancement of compensation based on the records already available with him transferred from the District Collector, Salem, the second respondent. Such exercise shall be completed within a reasonable period of time preferably on or before 29.4.2011. If for any reason, the District Collector, Villupuram, is unable to conclude the proceedings as above, the petitioner shall be informed and proceedings concluded at the earliest. The writ petition is disposed of as above. No costs.
