In view of the grounds taken in the application, duly supported by an affidavit, the delay in filing the present review petition is condoned. The application stands disposed of. C. Rev. No. 21 of 2011 The judgment in CWP No. 1660 of 2008, dated 30.8.2009 is recalled. The petition stands disposed of. C.W.P. No. 1660 of 2008. With the consent of parties, the petition was heard afresh. The limited prayer made by the petitioner is that he may be permitted to assail the order of disciplinary authority before the appellate authority. Consequently, the petition is disposed of with a direction to the petitioner to file an appeal, within a period of two weeks from today. Thereafter, the appellate authority shall decide the same in accordance with law on the basis of the pleas/grounds taken in the appeal by passing a speaking order, within a further period of eight weeks after the production of a certified copy of this judgment by the petitioner. No costs.
