Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents to consider the applications of the petitioners given during February 2010 and the representation dated 18.2.2011, in the light of the instructions of the Central Empowered Committee dated 11.12.2008 and notification of the 1st respondent dated 26.11.2010, as applied in the case of all similarly placed persons and consequently include the names of the applicants in the final list of saw mills and issue licence under Rule 11 of the Tamilnadu Regulation of Wood Based Industries Rules 2010 to run the Saw Mills of the petitioners. 2. Mr.S.N. Kirubanandham, learned Special Government Pleader, takes notice on behalf of the respondents. By consent of both parties, the writ petition is taken up for final disposal. 3. Heard Mr.K. Venkataramani, learned Senior Counsel appearing for the petitioners. 4. Mr.S.N. Kirubanandan, learned Special Government Pleader (Forests) appears for the respondents who states that the authority will consider the petitioners claims as may be directed by this Court. 5. Without going into the merits of the case as stated by Special Government Pleader appearing for the respondents, the first respondent is directed to consider the representation of the petitioners on its own merits and in accordance with law. The authority shall give opportunity of hearing the petitioners preferably on or before 7.4.2011 so as to avoid the allegation of violation of principles of natural justice. The Writ Petition is disposed of as above. No costs. 6. Learned Senior counsel appearing for the petitioners states that petitioners will pay a sum of Rs.5,000/- voluntarily to the Tamil Nadu Legal Services Authority, High Court Campus, Madras today.
