Judgment :- 1. In view of the averments made in the affidavit filed in support of the writ petition and in view of the submissions made by the learned counsels appearing for the parties concerned, the third respondent is directed to consider and dispose of the appeal, dated 21.1.2011, filed by the petitioner, in respect of the amount of income tax payable by the petitioner, relating to the assessment year 2008-09, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, on the petitioner paying a sum of Rs.3,00,000/- (Rupees Three lakhs) before the first respondent, as part of the tax due from the petitioner, within a period of two weeks from today. 2. The writ petition is ordered accordingly. No costs. Connected M.P.No.1 of 2011 is closed.
