Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to cancel the allotment made in favour of the third respondent and further direct the respondents 1 and 2 to allow the petitioner to carry on trade in the shop bearing F-76 situate in Anna Fruit Market, Koyambedu Wholesale Market Complex (KWMC), Koyambedu, Chennai. 2. Mr.C.Kathiravan, learned counsel takes notice on behalf of the respondents 1 and 2. In view of the order to be passed in this writ petition, the notice to the third respondent is dispensed with. By consent of both parties, the writ petition is taken up for disposal. 3. Though the writ petition has been filed for a larger relief to cancel the allotment made in favour of the third respondent, the leaned counsel for the petitioner now fairly states at the time of admission that the petitioner's grievance will be met if the representation dated 29.1.2011 addressed to the second respondent is directed to be considered on merits and in accordance with law. 4. In view of the submission made by the learned counsel for the petitioner, the second respondent is directed to consider the representation dated 29.1.2011 and pass appropriate orders on its own merits and in accordance with law within a reasonable period of time, preferably within six weeks from the date of receipt of a copy of this order. If any order adverse to the third respondent is to be passed, the said person shall be duly noticed so as to avoid allegation of violation of principles of natural justice. The Writ Petition is disposed of as above. No costs.
