JUDGMENT Kurian Joseph, C.J The writ petition is filed with the following prayers: “i) Grant of equal pay for equal work from the date the petitioner has been operating JCB/Excavator till the services of the petitioner are regularized. ii) Regularization of services of the petitioner as Excavator Operator on completion of 8 years of service or in the alternative grant him work-charged status on completion of 10 years of daily waged service with all consequential benefits from the due date.” 2. At para-2 of preliminary submissions of the reply, it is stated as follows: “2. That the case for creation of post of L&T/Excavator operator is under consideration at Govt. level and the services of the petitioner will be regularized on availability of sanctioned post.” 3. There will be a direction to the first respondent to take a final decision in the matter of creation of posts as referred to in the reply within a period of three months from the date of production of a copy of this judgment alongwith a copy of the writ petition by the petitioner. Depending on the action thus taken, the needful shall be done by the second respondent within another one month. 4. With the above observations, the writ petition stands disposed of, so also the pending miscellaneous application(s), if any.
