JUDGMENT Kurian Joseph, C.J. The Writ Petition is filed mainly with the following prayers: “(i) That writ in the nature of mandamus may kindly be issued, directing the respondents to regularize the services of the petitioner when he completed 8 years of service as per the judgment rendered by the Hon’ble Court in Rakesh Kumar Vs. State of H.P. since the petitioner was engaged w.e.f. 1.1.1994 and he was entitled to be given work charged status/regularization w.e.f. 1.1.2002, whereas, he has been given work charged status w.e.f. 15.1.2007. (ii) That writ in the nature of mandamus may kindly be issued, directing the respondents to count half of the service rendered by the petitioner on daily waged basis (i.e. w.e.f. 1.1.1994 to 1.1.2002) i.e. 4 years and the service rendered on regular basis for the purpose of pension and pensionary benefit and grant the pension and pensionary benefits to the petitioner from the due date. (iii) That writ in the nature of certiorari may kindly be issued, quashing the impugned order dated 24.5.2010 (Annexure P-3) whereby the petitioner has been ordered to be retired/superannuated w.e.f. 31.5.2010 on attaining the age of 58 years, whereas, he was entitled to remain in service till the age of 60 years as per the notification Annexure P-2.” 2. According to the petitioner, the issue is covered in his favour by the decisions of this Court rendered in CWP No. 2735 of 2010, Rakesh Kumar Versus State of H.P. & ors. and State of Himachal Pradesh & ors Versus Sarab Dayal in CWP No. 180 of 2001, decided on 19.7.2007. It is for the respondents to examine the matter. Therefore, this writ petition is disposed of directing the respondents concerned to examine the matter in the light of the judgments, referred to above and take appropriate action thereon within a period of four months from the date of production of copy of this judgment along with copy of the writ petition and copy of the judgments, referred to above. 3. The writ petition is disposed of, so also the pending application (s), if any.
