body2011
JUDGMENT : Rajiv Sharma, Judge: Mr. R.P. Singh, learned Assistant Advocate General has placed on record a copy of letter dated 29th March, 2011. A bare perusal of the same makes it abundantly clear that the grievance of all the petitioners for the release of salary by way of grant-in-aid has been redressed w.e.f. 2001 on wards. 2. Mr. Dushyant Dadhwal, learned counsel for the petitioners submits that six petitioners, namely, Mrs. Uttra Thakur, Mrs. Urmil Katoch, Mrs. Manisha Sharma, Mrs Rekha Chaudhary, Mrs. Saroj Bala and Mrs. Thakri Devi are in fact entitled to salary through grant-in-aid w.e.f. 1993 on the basis of judgment rendered by their Lordships of the Hon’ble Supreme Court in State of H.P. Versus H.P. State Recognised & Aided Schools Managing Committees and others (1995) 4 Supreme Court Cases 507. It is not in dispute that the present school was also included in the list of 144 schools. 3. Consequently, there shall be a direction to the Management of the school to forward the case of six petitioners, whose names have mentioned hereinabove, for the release of salary through grant-in-aid w.e.f. 1993, also in accordance with law. Thereafter, the respondent-State shall consider the case of these petitioners at par with those persons, who in the similarly situate schools have also been released this benefit w.e.f. 1993, within a period of four weeks. It shall be open to the Management to supply all the documents to the respondent-State while moving the case of aforesaid petitioners for the release of grant-in-aid. This order has been passed in the interest of justice to cut-short the litigation. 4. With the aforesaid observations/directions, the petition stands disposed of, so also the pending application(s), if any. Notices are discharged. No costs.
