JUDGMENT Deepak Gupta, J. 1.By means of this petition, the petitioner-wife has sought transfer of the divorce petition being HMA No.17-S/3 of 2010 titled Tulsi Ram Vs. Anita Sharma from the court of the learned Additional District Judge, Solan to the Court of the learned District Judge, Bilaspur. 2.I have heard learned counsel for the parties. From the record, it is apparent that the petitioner-wife lives near Bilaspur and she at the time of filing of this petition was pregnant. She has delivered a small child and, therefore, it is apparent that she has to look-after her small baby. It has also been brought to my notice by Sh.Abhinay Sharma, learned counsel for the petitioner that other litigation between the parties is pending at Bilaspur. Therefore, no prejudice shall be caused to the husband-respondent in case the matter is transferred from Solan to Bilapur. Keeping in view all these facts, I feel that the interest of justice would be served in case the HMA No.17-S/3 of 2010 is transferred from Solan to Bilaspur. 3.Keeping in view the aforesaid facts and circumstances of the case, it is directed that HMA No.17-S/3 of 2010 pending in the Court of learned Additional District Judge, Solan is transferred to the Court of learned District Judge, Bilaspur. The parties through their counsel are directed to appear before the learned District Judge, Bilaspur on 20.4.2011. 4.The petition is disposed of in the aforesaid terms. No order as to costs.
