JUDGMENT 1. - By this writ petition, a challenge has been made to the physical test conducted by respondents for the post of Constable. 2. It is stated that after qualifying the written test, petitioners were called for physical test. They were declared failed in the running as it was not counted properly and the rounds of running are otherwise recorded. Thus, prayer is to permit the petitioners to make a representation for their grievance. 3. I have considered submissions made and perused the record carefully. 4. In a number of cases, it is seen that chest and height measurement of the candidates has given cause to the litigation. In a few cases, one and the same candidate was physically examined twice as he qualified for the post of Constable and other post so advertised and therein for one and same candidate, different measurement for chest and height has been given. This Court accordingly called learned Additional Advocate General to explain aforesaid position and matter is now pending before this Court. The same is the position in regard to running. Since aforesaid dispute has been raised by many candidates, hence, for the ends of justice, respondents are directed to consider the case of the petitioners pursuant to their representation if it is made within two weeks from today. If petitioners' grievance is found to be genuine, consequential relief may be granted to petitioners without dragging them in further litigation. Necessary exercise may be undertaken within a period of two weeks from the date of receipt of certified copy of this order and representation.With the aforesaid direction and liberty, writ petition is disposed of. This disposes of stay application also.Writ Petition Disposed of as Above. *******
