Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents to permit the petitioner to install the small bunk shop at Whites Road, Wesley Higher Secondary School Compound Wall, opposite to Express Avenue (EA), Whites Road, Chennai-14 pending disposal of the petitioner's representation dated 21.2.2011 for the issue of suitable recommendation to the second respondent for the issue of licence to the petitioner. 2. Mr.S.Shivashanmugam, learned Government Advocate, takes notice on behalf of the first respondent. Mr.V.Bharathidasan, learned counsel takes notice on behalf of the second respondent. By consent of both parties, the writ petition is taken up for disposal. 3. Petitioner claims to be a physically handicapped person and states that he is having a bunk shop near Wesley Higher Secondary School compound wall, Whites Road, Chennai-14. Recently, the officer of the second respondent have removed the bunk shop. Petitioner has therefore, made a representation on 21.2.2011 to the first respondent to consider his claim for allocation of a place to eke out his livelihood. 4. Mr. S.Shivashanmugam, learned Government Advocate appearing for the first respondent and Mr.V.Bharathidasan, learned counsel appearing for the second respondent state that all the shops in that place were evicted so as to provide free flow of traffic and no decision has been taken to allot the place for any other person and the apprehension expressed by the petitioner is without any basis. 5. Considering the nature of relief sought for the first respondent is directed to consider the representation on its own merits and dispose of the same in accordance with law within four weeks from the date of receipt of a copy of this order. 6. The Writ Petition is disposed of as above. No costs. Consequently, connected miscellaneous petition is closed.
