It is not in dispute that the present lis is squarely covered by the judgment rendered by this Court in Madan Lal Tomar and others versus State of Himachal Pradesh and another,CWP(T) No.6018 of 2008, decided on 22.3.2010. 2. Accordingly, the present petition is allowed. Annexure A-5, dated 15.12.2004 is quashed and set aside. The pending application(s), if any, also stands disposed of. No costs.
