Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to forthwith entertain, process and grant electricity connection to 10 units along with 1 common line in property developed by the petitioner T.S.No.33/2, Kottur Village, Plot No.19, Old Door No.17, New Door No.18, Block No.34, 2nd Crescent Park Road, Adyar, Chennai without insisting completion certificate from the third respondent. 2. In view of the Division Bench order passed earlier, the third respondent was called upon to inspect the premises and give a report as to whether there is any major violation in the construction. On a direction by this Court, the property was inspected and report has been filed by the third respondent. 3. On a perusal of the report filed by the third respondent, certain violations have been indicated in the report. There is violation with regard to floor space index area (i.e.) 0.06 and 74.12 square meters in excess that is relatable to a small room constructed on the fifth floor. Petitioner's counsel on instruction states that the petitioner will voluntarily remove the small room on the fifth floor and in view of such undertaking given by the petitioner's counsel and considering the marginal violation, the respondents 1 and 2 are directed to effect electricity service connection without insisting the completion certificate from the third respondent, if the application is otherwise in order. The writ petition is ordered as above. No costs.
