JUDGMENT Kurian Joseph, J. The writ petition is filed with the following prayer:- “1. Issue writ in the nature of the certiorari for setting aside the impugned order dated 14.2.2011 (Annexure P-5) passed by the Hon’ble DRAT, Delhi and order dated 1.2.2011 (Annexure P-4) passed by the Hon’ble DRT Chandigarh and to direct the Hon’ble DRT-I Chandigarh to transfer back the Civil Suit No. 36/09 for trial in this Hon’ble High Court in the interest of justice and in the alternative the petitioner may kindly be allowed to be refund of the court fee deposited at the time of filing of the civil suit no. 36/09 with this Hon’ble Court and/or issue any other appropriate writ, order or direction which this Hon’ble Court may deem fit and proper in the present facts and circumstances of the case, may kindly be issued. It is further prayed that during the pendency of the present writ petition further proceedings before the Hon’ble DRT-I Chandigarh in O.A. No. 143 of 2009 may kindly be stayed in the interest of justice.” 2. After having heard the learned counsel for the petitioner for sometime, realizing that the petitioner has to pursue the remedies, if available, against Annexure P-1, order, in accordance with law, learned counsel seeks permission to withdraw the writ petition without prejudice to liberty to pursue the matter in accordance with law. Permission granted. It is submitted that now, the matter is posted before the DRT-I, Chandigarh for final hearing. The petitioner may make an appropriate application before the DRTI, Chandigarh apprising DRT of the course of action, it proposes to be pursued. 3. With the above observations, the writ petition stands disposed of, so also the pending application (s), if any.
