Judgment :- 1. Writ Petition is filed praying to issue a Writ of Mandamus, directing the respondents to take action on the basis of the enquiry report submitted by the third respondent on 5.1.2010 on the basis of complaint given by the Ward Members. 2. Mr. S.Shivashanmugam, learned Government Advocate, takes notice on behalf of the respondents. By consent of both the parties, the writ petition is taken up for final disposal. 3. The ward member of Chitheri Village Panchayat seeks a mandamus against the first respondent to pursue his complaint against the said Village Panchayat President stating that the enquiry has been conducted by the third respondent Deputy Block Development Officer. In view of the admitted fact that action has been initiated against the third respondent, it goes without saying that the authorities will have to pursue the matter in accordance with the Tamil Nadu Panchayat Act. Therefore, no specific direction can be given except to observe that the first respondent shall deal with the matter as expeditiously as possible. 4. If any action is contemplated against the said elected Village Panchayat President, it shall be in terms of the provisions of the Tamil Nadu Panchayat Act. 5. The Writ Petition is disposed of as above. No costs.
