JUDGMENT Deepak Gupta, J. By means of this petition, the petitioner has prayed that he may be regularized after completion of eight years of service. The petitioner admittedly, completed 240 days of service for the first time in the year 1994. Therefore, the judgment in Mool Raj Upadhyaya’s case is not applicable in his case. However, his case is covered by the judgment rendered by this Court in Gauri Dutt & ors. Vs. State of H.P Latest HJL 2008 (HP) 366 wherein the second question posed was as follows:- “If the answer to the first question is in the negative, what will be the process of regularization of services of those employees who had not completed 240 days of service in a calendar year as on 31st December, 1993 or had joined service after 1st January, 1994?” This question was answered in the following terms:- “16. Under para 4 of the scheme, the State was under an obligation to regularize all daily waged/muster roll workers whether they had joined prior to 31.12.1993 or thereafter. The State has framed a scheme in this behalf on 6th May, 2000. In our opinion, those employees who are not governed by the directions given in Mool Raj Upadhyaya’s case as set out by us above, shall be governed by the scheme of 2000. The second question is answered accordingly.” The petitioner, therefore, shall be governed by the policy of 2000 and the State is directed to grant him work charge status/regularization in terms of this policy. The needful be done on or before 31.5.2011. The petition is disposed of in the aforesaid terms. No order as to costs.
