JUDGMENT 1. - Heard learned counsel for the parties and perused the case diary. 2. Learned counsel for the petitioners submits that the petitioners were in possession of the land in question for the last about 30 years and a false case has been made out against the petitioners. 3. Learned Public Prosecutor submits that the matter has been investigated completely and the police has prepared the charge sheet against the petitioners for various offences under Sections 447, 379 read with Section 34 I.P.C. and Section 3(5) of the SC/ST Act. 4. In view of the aforesaid, when the matter has been investigated and the police has come to a conclusion that prima facie case is made out against the petitioners, then, It would not be proper for this Court to go into the merits and demists of the case. After the charge sheet is filed, the petitioners are always at liberty to raise all the objections before the concerned Court at the stage of framing of charges. 5. Accordingly, this misc. petition as well as stay petition stand disposed of.Petition disposed of. *******
