JUDGEMENT Gopal Prasad, J. 1. Heard learned Amicus Curiae and learned counsel for the State. 2. This appeal is directed against the order of acquittal passed by Shri Anil Kumar Jaiswal, Judicial Magistrate, Ist Class, Danapur. 3. The complaint case filed in the year 1982 by the Secretary, Bihar Agricultural Produce Market Act that accused persons are violated the provision of Bihar Agricultural Produce Market Act and engaged in sale and purchase of rice, pulses and other food articles and hence are reliable to be prosecuted under Section 48 of Bihar Agricultural Produce Market Act and 27, 98 and 82 of the Act and rules. 4. The allegation with regard to occurrence is of the year 1982 and the appeal has been filed in the year 1998. 5. Hence in the public interest itself there is no merit to pursue the appeal. Accordingly, this appeal is dismissed.
