Judgment :- 1. The main contention of the learned counsel appearing for the petitioner is that the detailed reply submitted by the petitioner, on 2.11.2010, for the notice, dated 5.10.2011, issued by the respondent, had not been considered before the respondent had passed the impugned assessment order, dated 4.3.2011. Therefore, he had prayed that this Court may be pleased to set aside the impugned order of the respondent, dated 4.3.2011, permitting the respondent to pass an assessment order, for the assessment year 2010-2011, afresh, considering the reply submitted by the petitioner, on 2.11.2010. 2. The learned Additional Government Pleader, (Taxes), appearing for the respondent has no objection for such an order being passed by this Court. 3. Hence, the impugned order of the respondent, dated 4.3.2011, is set aside. The respondent is directed to pass a fresh assessment order, for the assessment year 2010-2011, considering the reply, dated 2.11.2010, submitted by the peitioner, within a period of four weeks from the date of receipt of a copy of this order. The writ petition stands ordered accordingly. No costs. Connected M.P.No.1 of 2011 is closed.
