Satya Poot Mehrotra and Anil Kumar Agarwal, JJ.- It ap­pears that the Fair Price Shop Dealership of the petitioner was cancelled vide order dated 8.8.2011 passed by the respondent No. 3. The petitioner has there­after filed an Appeal before the respondent No. 2 on 12.8.2011 challenging the said order dated 8.8.2011 passed by the respondent No. 3. The said Appeal is still pending. In the meantime the petitioner has filed the present writ peti­tion seeking the relief as mentioned in the 'Prayer' clause of the writ petition. 2. We have heard Sri S. K. Mishra, learned Counsel for the petitioner. From the narration of the facts it is clear that the petitioner has already availed the alternative remedy of appeal available to the petitioner. 3. In the circumstances, we are not inclined to exercise writ jurisdiction of this Court under Article 226 of the Constitution of India and the writ petition is liable to be dismissed on the said ground and it is, accordingly, dismissed on the said ground. Petition Dismissed.
