JUDGMENT 1. - The petitioners have been arrested in connection with F.I.R. No. 177/2011, registered at Police Station, Shahpura, Bhilwara for the offences under Sections 143, 452, 323, 354 and 504 I.P.C. 2. Heard learned counsel for the petitioners, learned Public Prosecutor and perused the case diary. 3. Counsel for the petitioners submits that the allegations of the complainant regarding injuries having been inflicted on his wife has not been corroborated by the medical report. He further submits that only non-bailable offence now in the matter is Section 452 I.P.C. and the petitioners are in custody for nearly one month. 4. Learned Public Prosecutor opposes the bail application. 5. Having regard to the facts and circumstances of the case and looking to the fact that the petitioners are in judicial custody for nearly a month and that the medical examination of the injured does not disclose the injuries of nature as have been alleged in the F.I.R. and looking to the fact that the only non-bailable offence in the matter is Section 452 I.P.C., without expressing any opinion on the merits of the case, I am inclined to grant bail to the petitioners under Section 439 Cr.P.C. 6. Accordingly, the same is allowed and it is directed that petitioners (1) Gheesu S/o Shri Mithu Lal Jat, (2) Chothu S/o Shri Unkar Mali, (3) Balu S/o Shri Chothu Mali, and (4) Godu S/o Shri Chothu Mali shall be released on bail in F.I.R. No. 177/2011, registered at Police Station, Shahpura, Bhilwara provided each of them executes a personal bond for a sum of Rs. 30,000/- along with two sound and solvent sureties in the sum of Rs. 15,000/- each to the satisfaction of the learned trial Court for their appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.Bail application allowed. *******
