JUDGMENT 1. - This criminal misc. petition under Section 482 Cr. P.C. has been filed against the order dated 30.3.2011 passed by the learned Additional District & Sessions Judge, Behror, District Alwar, in revision petition No. 62/11 whereby the order dated 6.1.2010 passed by the learned Civil Judge (S.D.) and Additional Chief Judicial Magistrate in criminal case no. 590/08 by which the application of the petitioners for re-examination of disputed documents from FSL was dismissed and revision petitions were dismissed. 2. Brief facts of the case are that Smt. Ramoti d/o Late Shri Chand Kaur has filed a complaint regarding allegation as to fabrication of will of her mother dated 20.11.2006 Police Station Behror registered FIR No. 24/07 against the petitioners dated 02.1.2007 for the offence under Sections 420, 467, 468, 471 and 120-B IPC. 3. Thereafter, investigating agency filed charge sheet of the aforesaid offences. 4. Learned counsel for the accused petitioners has contended that an expert opinion was required to be obtained in relation to admitted document from disputed document and even in first information report there is no admitted contemporary document and relying on that dismissed the prayer of the petitioners. 5. In the facts and circumstances of the case it was just and proper to send the disputed will for FSL but the learned trial court passed its order contrary to the provisions of section 45 of Evidence Act and the learned revisional court also ignored the mandate of section 45 of the Evidence Act. Hence, the disputed document should be sent against to F.S.L. 6.

I have heard learned counsel for the respective parties and gone through the material available on record. 8. In view of above discussion and observation made by the court below I do not think it proper to interfere with the orders impugned as the same are just and proper. 9. The criminal misc. petition having no force is hereby dismissed. 10. Since the misc. petition itself has been dismissed, the stay application stands dismissed.Petition dismissed. *******
