JUDGMENT 1. - Counsel for the petitioners does not press this revision petition qua petitioners Nos. 1 and 2. Therefore, the revision petition on behalf of the petitioners No. 1 and 2 is dismissed as not pressed. 2. However, he submits that the petitioners No. 3 to 8 namely, Gordhan Ram, Jivna Ram, Bala Ram, Rana Ram, Lilu Ram and Arjun Ram were only charge-sheeted for the offence under Section 201 Cr.P.C. (sic I.P.C.) and the learned lower Court mechanically framed charges for the offences under Sections 304-B and 498-A I.P.C. against them. 3. Learned Public Prosecutor and the learned counsel for the respondent No. 2 are not in a position to dispute this factual aspect that charge-sheet as regards the petitioners No. 3 to 8 was filed only under Section 201 Cr.P.C. (sic I.P.C.). 4. I have perused the challan papers. As per the challan papers, the allegation of harassment and humiliating the deceased for bringing less dowry is not against the petitioners No. 3 to 8 namely, Gordhan Ram, Jivna Ram, Bala Ram, Rana Ram, Lilu Ram and Arjun Ram. They are only alleged to be the persons who were responsible for destruction of evidence and as such, charge-sheet filed against them was only for the offence under Section 201 Cr.P.C. (sic I.P.C.). The trial Judge has clearly erred in framing charges against them under Sections 498-A and 304-B I.P.C. 5. Accordingly, this revision petition is partly allowed. The charges framed against the petitioners No. 3 to 8 Gordhan Ram, Jivna Ram, Bala Ram, Rana Ram, Lilu Ram and Arjun Ram for the offences under Sections 498-A and 304-B are hereby quashed. The trial of the petitioners No. 1 and 2 for all the offences and of the petitioner Nos. 3 to 8 for the offence under Section 201 Cr.P.C. (sic I.P.C.) shall continue.Revision partly allowed. *******
