S.C. Agarwal, J.;- Heard learned counsel for the petitioner and learned A.G.A. for the State. 2. This writ petition has been filed with a prayer to quash the order dated 08.08.2011 passed by Acting District Judge/Additional Sessions Judge, J.P. Nagar in Criminal Revision No. Nil of 2011 (Mahaveer Singh Vs. State of U.P. and others) arising out of criminal complaint No.2713 of 2009 under Section 420 I.P.C. Police Station Mandi Dhanaura, District J.P. Nagar, whereby the petitioner has been summoned under Sections 420 I.P.C. Police Station Dhanaura, District J.P. Nagar to face trial. 3. The summoning order has been passed on the basis of material available on record as well as statements of the complainant and the witnesses recorded under Sections 200 and 202 Cr.P.C. The revision filed by the petitioner has been dismissed. The summoning order does not suffer from any illegality and does not call for any interference by this Court. 4. However, the writ petition is disposed of with a direction that if the petitioner surrenders before the Magistrate concerned within a period of three weeks from today and applies for bail, his prayer for bail be considered by the Courts below keeping in view a Full Bench decision of this Court in the case of Amarawati and another vs State of U.P. 2004 (57) ALR. 290 as affirmed by Hon'ble Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. 2009 (3) ADJ 322 (SC). 5. If for any reason, disposal of the bail application on the same day is not possible, then the petitioner shall be released by the Courts below on interim bail till the final disposal of his bail application. 6. For a period of four weeks, no coercive steps shall be executed against the petitioner.
