MOHAMMAD RAFIQ

body2011
RAFIQ, J.—This appeal has been preferred dissatisfied with the quantum of compensation in the sum of 47,500/- that has been awarded by the Motor Accident Claims Tribunal, Jaipur City, Jaipur. 2. Contention of the learned counsel for the appellant is the learned Tribunal erred in law in not taking into consideration that the appellant was working in a pharmaceutical firm and his income was Rs.4,500/- per month and awarded nothing under this head. Learned Tribunal further erred in law while awarding lump sum amount of compensation of Rs.30,000/- under the head of permanent disability and further granted meager amount of compensation of Rs.10,000/- under the head of physical pain and suffering and in total awarded a sum of Rs.47,500/-, which is quite unreasonable. 3. Having heard learned counsel for the appellant and perused the impugned award, I find that even if the computation of the compensation is made according to the prescribed formula being applied the multiplier of 17 as at the relevant time age of the deceased was 24 years, the amount of compensation does not exceed what has been awarded to be appellant according to his entitlement. 4. The appeal has no merit, which is accordingly dismissed.
