JUDGMENT : This application has been filed for restoration of Writ Appeal No.1100/10 which was dismissed because of non-compliance of peremtory order dated 12.11.2010. Learned counsel for petitioner submitted that the writ appeal was dismissed because of non-compliance of the aforesaid peremptory order by which the petitioner was directed to make the default good within a period of one week, failing which the appeal was directed to be dismissed without further reference to the Bench. The default as pointed out in the appeal was in respect of non-supplying advance copy to the counsel for respondent No.4. It is submitted that aforesaid lapse has occurred because of inadvertence and the petitioner be allowed one opportunity to make the default good. Considering the peculiar facts of the case, in the interest of justice, we allow this MCC No.13/2011 with following directions:- 1. Petitioner to serve copy of Writ Appeal No.1100/2010 to the counsel for respondent No.4 who appeared in the writ petition on his behalf within a period of one week from today and to file acknowledgement in the office. 2. If direction No.1 is complied with, office to restore Writ Appeal No.1100/2010 to its number and to place it before an appropriate Bench. In case of non-compliance, earlier order shall stand. No order as to costs.
