Hon'ble RAFIQ, J.—This appeal has been preferred by the appellant United India Insurance Company Ltd. on the ground that two claim petitions were filed by different claimants. While Claim Petition No.489/2004 (639/1999) was filed by Smt.Gracy Jain, two daughters & two sons, another Claim Petition No.490/2004 (100/1999) was filed by Smt.Grace Jain. The instant appeal arise out of Claim Petition No.1801/1999 filed by Smt.Manju Jain and six other claimants. 2. Learned counsel for the appellant has pointed out that Claim Petition No.489/2004 (639/1999) was initially dismissed by the Motor Accident Claims Tribunal, Beawar, Ajmer vide order dated 16.6.2008, copy of which is taken on record. 3. If that is the only ground on which the appeal has been filed, that argument cannot survive now in view of dismissal of the claim petition filed by Smt.Gracy Jain. It is informed that Smt.Gracy Jain has not filed any appeal against the aforesaid order and the award in the case of Smt.Grace Jain has become final and there is impediment for grant of relief in the present case. 4. The appeal has no merit and it is accordingly dismissed. The record be transmitted back to the Tribunal forthwith.
