Judgment :- 1. The appellant-C.Swaminathan appeared in person and he would submit that he is withdrawing the vakalat given to his advocate. 2. Despite printing the name of the advocate concerned for the appellant, there is no representation. Hence, the appellant is permitted to appear for himself. 3. The appellant and the respondent jointly presented the memo of compromise and prayed this Court for recording the same and disposing of the second appeal. Hence, they were directed to appear before the Deputy Registrar to record their statements. 4. As per the direction of this Court, the Deputy Registrar(AS) recorded the statements of both the appellant and the respondent and they affirmed the contents of the joint memo of compromise. The identity of the appellant-C. Swaminathan was also got verified. The learned counsel for the respondent also identified both the appellant and the respondent. Before me also both the appellant and the respondent affirmed the contents of the joint memo of compromise. 5. I am having no reason not to record the said compromise. Accordingly, the compromise is recorded, as it has been voluntarily entered into between the parties. The memo of compromise shall form part and parcel of the decree of this Court. Based on the said compromise, the judgements and decrees of the Courts below shall stand set aside. However, there is no order as to costs. Accordingly, the S.A. is disposed of. Consequently, connected miscellaneous petition is closed.
