JUDGMENT Deepak Gupta, J. The appeal filed by the petitioner has been rejected vide order dated 3.7.2004, Annexure A/9 by the Divisional Manager, Himachal Road Transport Corporation, Shimla only on the ground that the same is time barred. The order which was subject matter of appeal was passed on 30.1.2004. It is not clear on which date this order was supplied to the petitioner. The appeal even as per the order dated 3.7.2004 was filed on 19.3.2004. The delay in filing the appeal, if any, was very little. Therefore, the order dated 3.7.2004 is set aside and the appellate authority is directed to decide the appeal of the petitioner on merits on or before 30.4.2011. The petition is disposed of in the aforesaid terms. No order as to costs.
