JUDGMENT : P.K. Jaiswal, J.:- By this writ petition the petitioner is praying for deleting the condition by which respondent No.1 while granting revolver licence directed the petitioner to surrender 12 bore gun licence. It is submitted that no such condition can be imposed by the licencing authority and he also submits that no reason has been assigned by the licencing authority while imposing such condition in the order dated 24.09.2008 (Annexure P/1). On a perusal of the impugned order Annexure PI dated 24.09.2008, it is found that the licencing authority without assigning reasons imposed the conditions to surrender 12 bore gun licence. Learned Counsel for the petitioner drew my attention to Annexure P/13 By which revolver licence to one Jitendtra Singh Patel has been granted and submitted that number of persons in the same district are having arms licence of 315 bore guns licence as well as revolver licence but no such condition has been imposed by the licencing authority. He also drew my attention to Section 14 of the Arms Act 1949 and submitted that where the licencing authority refuses to grant licence to any person, it shall record reasons for such refusal. The licencing authority without assigning any reasons directed the petitioner to surrender 12 bore gun licence which is in violation of principle of natural justice. For the above mentioned reasons, the impugned order dated 24.09.2008 so far as imposing conditions for surrender of 12 bore gun licence is hereby set aside with a direction to the learned authority to decide it afresh and thereafter pass a speaking order within a period of six weeks form the date of filing of certified copy of the order.
