JUDGEMENT 1. Heard learned counsel for the petitioner, counsel for the State and the Union of India. 2. Petitioner is a Non-Government Organization was earlier entrusted with Balwadi Nutrition and Early Childhood Education Programme of the Government of India. Later the Balwadi Nutrition, Early Childhood Education Programme was abolished and Integrated Child Development Scheme Centre(s) was established in the light of the instructions of the Government contained in letter dated 10.11.1996, Annexure-4. It is submitted on behalf of the petitioner that taking into account the satisfactory service rendered by the petitioner organization the Social Welfare Directorate of the State Government should consider entrusting the ICDS, Centre(s) to the petitioner. For such purpose, petitioner has requested the Commissioner and Secretary of the Social Welfare Department under representation dated 29.9.2005 and the earlier representations which are annexed with this writ petition. 3. Having heard counsel for the petitioner, Union of India and State, I direct the Commissioner and Secretary of the Social Welfare Department Government of Bihar to consider the request of the petitioner for entrusting the petitioner with ICDS Centre(s) considering its past performance as according to the petitioner it has experience of managing 85 Balwadi Nutrition, Early Childhood Education Programme Centre(s), the request of the petitioner for entrusting with ICDS, Centre(s) as made out in representation dated 29.9.2005, Annexure-11 be considered by the Commissioner and Secretary of the Social Welfare Department of the State Government, in accordance with law, as early as possible, in any case within two months from the date of receipt/production of a copy of this order by the authorities. 4. Application stands disposed of.
