JUDGMENT V.K. Sharma, J The learned counsel for the petitioner submits that the case of the petitioner is squarely covered under judgment dated 22.12.2010 rendered by a learned Single Judge of this Court in CWP (T) No. 10422 of 2008, titled Veer Bala versus Himachal Pradesh University, Shimla, text whereof is as follows:- “Petitioner was placed in the pay scale of Rs. 12,840-14,100. However, vide Annexure A-5 dated rd April, 2003, the pay of the petitioner was re-fixed. Petitioner has neither been issued notice nor any opportunity of being heard has been given before issuance of Annexure A-5 dated 3rd April, 2003. Petitioner has suffered civil and evil consequences since her salary has been reduced without hearing her. 2. Consequently, the writ petition is allo0wed. Annexure A-5 dated 3rd April, 2003 is quashed and set aside. However, the liberty is reserved to the respondents to proceed with the matter in accordance with law. No costs.” 2. In view of the above, the petition is allowed. Consequently, impugned office order dated 3.4.2003, Annexure A-5 is quashed with a direction that if on facts the case of the petitioner is covered under the judgment referred to hereinabove and he is also similarly situate as the petitioner in the said case, he shall also be treated similarly without any discrimination and benefit of the said judgment shall also be extended to him. However, liberty is reserved to the respondents to proceed in the matter in accordance with law, if so advised. 3. The petition stands disposed of in the above terms, so also pending application(s), if any.
