Hon'ble RAFIQ, J.—This appeal has been filed by the claimant appellant dissatisfied with the quantum of compensation of Rs.29,030/- that was awarded by the Motor Accident Claims Tribunal Gangapurcity, District Sawai Madhopur vide award dated 28/5/2004 assailing on the ground that at the age of claimant of 60 years, he should have been awarded compensation on the basis of structured formula for the permanent disability of 12% sustained in the road accident involving the vehicle insured with the respondent-insurance company. Learned counsel argued that award of Rs.29,030/- is towards the lower side and the multiplier of 9 at the age of 60 years should have been adopted, as per the judgment of Supreme Court in Sarla Verma & Others vs. Delhi Transport Corporation & Another : (2009) 6 SCC 121 = 2009(1) CCR 276 (SC) = 2009(4) RLW 2785 (SC). The appellant due to permanent disability, is not able to sit cross-leg and squat and he cannot ride the bicycle. 2. Learned counsel for the respondent insurance company has opposed the appeal but could not dispute the ratio of the judgment of Supreme Court in Sarla Verma supra. 3. Upon hearing learned counsel for the parties and perusing the award, in my considered view, the award deserves to be enhanced. Accepting the income of Rs.150/- per day as has been held by the Tribunal, roughly income of the appellant would come to Rs.4,500/- per month and the annual income of the appellant comes to Rs.54,000/-. Multiplier of 9 is adopted accepting 12% permanent disability. Appellant is also entitled to Rs.1,000/- for fracture and Rs.4,000/- for nutritious diet. 4. In the result, the appeal is allowed and the award passed by the Motor Accident Claims Tribunal Gangapurcity, District Sawai Madhopur dated 28/5/2004 is modified in the following terms:- (a) Rs.150/- per day 150x30= 4500x12= 54000 (b) 54000x9x12%= 58320 (c) Award of Rs.230/- for medical expenses is maintained. (d) Rs.1,000/- is awarded for fracture (e) Rs.4,000/- is awarded for nutritious diet (f) 58320+5230= 63550. (g) Award of Rs.29,030/- is thus enhanced to Rs.63,550/-. (h) Appellant shall be entitled to interest @7.5% on the enhanced amount of compensation from the date of filing claim petition. (i) Compliance of the judgment shall be made within a period of three months from the date of production of certified copy of this order before respondent No.3-United India Insurance Co.Ltd., Gangapur City, District Sawai Madhopur.
