Hon'ble RAFIQ, J.—This is a fit case in which the appellants can be prosecuted for having given the false evidence on oath. In motor accident claims case, he has stated that Bus of the RSRTC was involved and on that basis claimed compensation. In the trial against driver of the said Bus Shiv Kumar when his statement was recorded in cross-examination clearly admitted that they filed a false claim case to receive compensation and that in fact, their motorcycle fell in the pit on its own and Bus No.RJ-11/P0397 was not present there. It is thus clear that either before the Motor Accident Claims Tribunal, Dholpur or before the Court of learned Judicial Magistrate Ist Class, No.2 Dholpur, this person has spoken a blatant lie and that too on oath. This is a fit case to direct his prosecution. 2. Station House Officer, Kotwali Dholpur is therefore directed to obtain all the relevant documents and make an investigation for that purpose and file challan against the person for giving false statement on oath and he may also verify from the statement of claimant-Virendra Singh as to whether similar statement was given by him also in the criminal trial against the driver. 3. The appeal is dismissed. Copy of the statement of Shiv Kumar is taken on record. The record be transmitted to the Tribunal forthwith.
