JUDGMENT 1. - Heard learned Counsel for the parties. 2. This is a transfer application filed by the petitioner-wife against respondent-husband for transferring the case under Section 9 of Hindu Marriage Act registered as Application No. 46/2010 titled as Rajendra v. Smt. Sumitra , pending in the Court of District and Sessions Judge, Tonk to the Family Court, Jaipur City, Jaipur (Raj.). 3. Counsel for the petitioner submits that the petitioner-wife is residing at Jaipur and she is living a miserable life at his father's home at Jaipur who is working as a Chowkidar at Jaipur. 4. Counsel for the respondent submits that District-Tonk is not a far distance. It is only 100 kilometres away from Jaipur. There will be no inconvenience for the petitioner to attend the case at Tonk. 5. I have gone through the transfer application and further considered the aforesaid submissions of the parties. 6. Considering the fact that the petitioner-wife is living miserable life at her father's house who is working as a Chowkidar at Jaipur and it is inconvenient for her to attend the Court at Tonk, therefore, I deem it proper to transfer the case No. 46/2010 titled as Rajendra v. Smt, Sumitra , pending in the Court of District and Sessions Judge, Tonk to the Family Court, Jaipur City, Jaipur (Raj.). 7. Both the parties are directed to appear before the Family Court, Jaipur City, Jaipur on 18th January, 2012. 8. The transfer application stands allowed as indicated above.Tr.
