ORDER 1. The applicant has preferred this application for gram of bail as he is arrested in connection with Crime No.35/2011 registered in Police Station-Saja, District - Durg (C.G.) for offence punishable under Sections 294, 506 B, 353, 332, 146/34 of I.P.C. 2. The applicant has been arrested on the allegation that at about 01.30 p.m. on 16/02/2010 he obstructed the complainant, who is S.D.O. (PWD) in discharge of his official duty and assaulted him by means of hand and fist. The said officer fell down from the chair and his spectacle was broken. 3. Learned counsel for the applicant would submit that he is an employee of the contractor and had gone to the officer at the instance of his employer to request the officer for making final payment of the bills, however, the complainant became annoyed as he did not intend to release the bills and make payment. 4. Learned State counsel has opposed the prayer for grant of bail. 5. Taking into consideration the totality of the circumstance and particularly the fact that offences are triable by the Judicial Magistrate First Class and applicant is in jail since 24/06/2011, this Court is inclined to release the applicant on bail. It is directed that the applicant shall be released only after submitting personal bond of Rs.25,000/- with one local surety in the like amount to the satisfaction of concerned trial Court. He is directed to appear before the said Court on each and every date given to him in that behalf. Application Allowed.
