JUDGMENT 1. - This order governs the disposal of bail application filed under Section 438 of Cr.P.C. by Shri S.K. Sharma, Advocate on behalf of the applicant Mukesh pertaining to F.I.R. No. 1/2010 of Police Station Garoth District Mandsoor, registered for the offences under Section 8/29 of N.D.P.S. Act. 2. Heard the learned counsel for the petitioner as also learned Special Public Prosecutor for the Union of India and perused the material on record. 3. Learned counsel for the petitioner canvassed that the recovery of 9 Kg and 900 grams of opium has been made from the accused Saudan Singh and Shankar Singh. No recovery has been made from the possession of the petitioner. The petitioner Mukesh apprehends his arrest to be made by the police on the basis of the statements of Saudan Singh and Shankar Singh and hence he deserves to be granted indulgence of pre-arrest bail. 4. Mr. Madnani appearing for the Union of India has opposed the bail petition. 5. It is highly shocking that even the persons entailed under the offence of N.D.P.S. Act 1988 are also daring to seek anticipatory bail from the High Court. I do not find any ground on the basis of which the anticipatory bail may be granted to the petitioner. The allegations as levelled against the petitioner do not seem to be false, baseless and groundless and, as such, the bail petition seeking pre arrest bail deserves, to be dismissed out rightly. 6. In the case of Pankaj v. State of Raj., RLW 1996 (1) Raj. 628 this Court has observed that the provision of Section 438 Cr.P.C., seeking Pre arrest bail sparingly used in rarest of the rare cases. Allegation of false implication and malafides must be made and proved. by the accused. This provision can be invoked by the Court only when the accusation levelled against the petitioner is found to be totally false, baseless and groundless. The accusation against the petitioner does not seem to be false and groundless. In view of the aforesaid discussion, the petitioner cannot be allowed pre-arrest bail. 7. For the reasons stated above, the bail petition filed on behalf of the petitioner Mukesh S/o Shri Narayan under Section 438 of Cr.P.C. stands dismissed.Bail application dismissed. *******
