JUDGMENT : The Court: Counsel for the first respondent that sold the goods in question at auction to the petitioners has received instructions to submit that if the petitioners pay sales tax at the flat rate of 13.5% for the whole lot with the price for the sold goods within the time fixed by the Court, then the first respondent will issue the delivery order immediately. Counsel for the second respondent submits that she has also received instructions to say that if the petitioners pay sales tax at the flat rate of 13.5% for the whole lot with the price for the sold goods, then the second respondent will deliver the goods. Counsel for the petitioners has submitted that the petitioners are ready to pay sales tax at the flat rate of 13.5% for the whole lot and the price at which the lot was sold, by next Tuesday. In view of the above-noted situation, I dispose of the petition ordering as follows. If the petitioners pay sales tax for the whole lot at the flat rate of 13.5% and the price for the sold lot by next Tuesday, then within a week from the date of payment the first respondent shall issue the delivery order; and on the basis of the delivery order the other respondents shall deliver the sold goods to the petitioners. No costs.
