JUDGMENT : The Court : Counsel submits as follows. The bank granted the petitioners Rs.70,000 loan. The amount was transferred to the petitioners’ savings bank account maintained with the bank. For undisclosed reasons from the account the bank transferred Rs.42,300 to an unknown account. Feeling aggrieved, the petitioners have brought this petition. On written instructions, counsel for the bank submits that the sum of Rs.42,300 was once again deposited in the petitioners’ savings account. After considering the bank statement, counsel for the petitioners submits that it is not known how a further sum of Rs.70,000 has been shown in the petitioners’ savings account as withdrawal. In my opinion, it will be appropriate to direct the bank to settle the accounts. For these reasons, I dispose of the petition ordering as follows. The petitioners will be free to make a detailed representation on the basis of the bank statement. Within two working days from the date of receipt of the representation the Manager of the branch concerned of the bank shall sit with the petitioners and settle the accounts and supply the petitioners complete statements. No costs.
