Judgment :- 1. In spite of service having been effected to the second respondent and the name of the second respondent has been printed in the cause list, neither the second respondent nor his counsel appeared before the Court. 2. The writ petition is for direction against the second respondent to forthwith issue the B.E., degree certificate, mark statement, original previous educational certificates of the petitioner, without insisting the payment of dues. 3. The grievance of the petitioner is that in spite of his request to the second respondent to issue the original certificates, statement of marks, the second respondent is demanding an amount of Rs.1,95,000/-. Hence, the petitioner has filed the present writ petition. 4. Inasmuch as the petitioner is stated to have completed the B.E., degree in the second respondent College, the second respondent is not entitled to demand such a huge amount, and after the completion of course no demand can be made except towards dues if any or arrears of fees. In respect of any dues or arrears of fees, it is for the second respondent to take appropriate steps and that cannot be a ground for the purpose of withholding the certificates of the petitioner. 5. Accordingly, the writ petition stands allowed with direction to the second respondent to issue B.E., degree certificate, mark statements, original previous educational certificates to the petitioner, without insisting for arrears of dues if any due to the second respondent forthwith. No costs.
